The Montana Public Service Commission (Commission) "has full power of supervision, regulation, and control of such public utilities" and "the authority to generally implement and enforce" the Montana Renewable Power Production and Rural Economic Development Act, also known as the Renewable Portfolio Standard (RPS). Mont. Code Ann. 69-3-102; 69-3-2005(7) (2011). The RPS requires public utilities to "purchase both the renewable energy credits and the electricity output from [CREPs] that total at least 50 megawatts in nameplate capacity." Id. at 69-3-2004(3)(b). After proportionately allocating the 50 MW requirement based on its retail sales of electrical energy in Montana in 2011, NorthWestern is responsible for about 44 MW of the total CREP requirement. NorthWestern Pet., Docket D2011.6.53, p. 4 (June 30, 2011); see Mont. Code Ann. 69-3-2004(3)(c). A public utility may petition the Commission for a short-term waiver from full compliance with the CREP requirement: The petition must include documentation and evidence showing that the public utility has undertaken all reasonable steps to procure renewable energy credits sufficient to comply with the applicable portfolio standards and could not achieve full compliance due to one or more of the following: (a) the unavailability of sufficient renewable energy credits; . . . (c) full compliance would cause the public utility to exceed the cost caps; and (d) other documented reasons beyond the public utility's control. Admin. R. Mont. 38.5.8301(4) (2011) (citing cost cap in Mont. Code Ann. 69-3-2007(1)). "The commission will rule on a petition for a waiver from full compliance with the renewable portfolio standards after noticing the petition and allowing an opportunity for a public hearing." Admin. R. Mont. 38.5.8301(5). In its Petition, NorthWestern asserted that it undertook all reasonable steps to comply with the CREP requirement, but that due to unavailability of CREPs, the cost caps and circumstances beyond its control, it could not comply.
